Wilmot Township Bylaws & FAQs

Answers to common questions from New Hamburg, Baden, St. Agatha and Petersburg homeowners about fence rules, permits, and material choices. Requirements can vary by property, so verify current rules with the Township of Wilmot before construction.

No. Under Township of Wilmot Fence By-law 2009-36, a standard residential fence does not require a building permit. The only exception is a fence enclosing a swimming pool, which requires a permit along with the pool itself. All fences must still meet the Township’s height and placement rules.
Fences in the side yard, exterior side yard, or rear yard can be up to 1.98 metres (6½ feet) high. Fences in the front yard, or within a driveway or corner visibility triangle, are limited to 0.75 metres (2½ feet). The corner visibility triangle is measured 7.5 metres along each lot line from where they meet at a street corner — no fence or hedge over 0.75m is allowed inside it.
For larger lots and rural-style properties common in Wilmot Township, we often recommend durable wood or vinyl privacy fencing for yard perimeters close to the house, and more economical options like page wire or post-and-rail for larger boundary runs where full privacy isn’t needed. The right choice depends on lot size, livestock or pets, wind exposure, and budget — we’ll walk through the trade-offs during your free quote.
Any pool with a design depth of 0.9 metres (3 feet) or more — including inflatable and above-ground pools — requires a building permit and a code-compliant enclosure. The fence must be at least 1.52 metres (5 feet) high, built so it cannot be climbed, and gates must have a self-closing, self-latching lock. The pool cannot be filled with water until the fence and gates are in place and approved.
