Waterloo Bylaws & FAQs

Straight answers for Waterloo homeowners planning a fence, pool enclosure, or deck — including the visibility-triangle rule that catches many corner-lot owners by surprise. Requirements can vary by property, so verify current rules with the City of Waterloo before building.

It depends on where the fence sits on your lot. Rear and interior side yards allow up to 2.44 metres (8 feet). Front yards and driveway visibility triangles are capped at 0.9 metres (3 feet). Corner-lot flankage yards allow up to 1.83 metres (6 feet). Decorative post caps, archways, and gates have small additional allowances under the City’s Fence Bylaw.
Waterloo defines two safety zones where fence height is restricted: the Daylight Visibility Triangle at a street corner (no fence allowed at all) and the Driveway Visibility Triangle where a driveway meets the street (fences capped at 0.9m/3ft, even if the driveway belongs to your neighbour). Corner-lot and shared-driveway properties should check both before finalizing a fence layout — this is one of the most common reasons a Waterloo fence plan needs adjusting.
Yes. Waterloo’s Pool Enclosure Bylaw requires an enclosure permit before you fill a new or replacement pool or hot tub with water. The enclosure must be at least 1.52 metres (5 feet) high with a self-closing, self-latching gate. Hot tubs with a lockable ASTM-compliant cover can qualify for a no-fee permit instead of a full fence enclosure.
A permit is required if your deck will be more than 24 inches (0.6m) above grade, or if it has a roof or cover. Lower, uncovered decks don’t need a permit but must still meet zoning setback rules. Where a guard is required by code, it generally needs to be at least 900mm high (1070mm if the deck is 1.8m or more above grade).
